For the purposes of Schedule 2 of the Australian Consumer Law, in particular Sections 51 to 53, 64 and 64A of Part 3-2, Division 1, Subdivision A of the Competition and Consumer Act 2010 (Cth), Flowers Vasette liability for any breach of a term of this agreement is limited to: the supplying of the goods or services to you again; the replacement of the goods; or the payment of the cost of having the goods or services supplied to you again. Event Terms 1.1. These terms and conditions ("Terms") govern the sale of goods and services by Flowers Vasette ("Company") to the customer ("Customer"). 1.2. By booking an event or purchasing products/services from the Company, the Customer agrees to be bound by these Terms. 1.3. This quotation is valid for 30 days and is subject to our standard terms and conditions which can be found at www.flowersvasette.com.au/terms-and-conditions. 2. Payment Terms 2.1. A non-refundable deposit of 20% of the total quoted price is required to secure the booking for events and services. 2.2. The remaining balance is due no later than 7 days before the delivery date of the services/products. 2.3. Payments can be made via credit card, debit card, or bank transfer. All payments must be made in AUD. 2.4. Failure to pay the balance by the due date may result in the cancellation of the booking or order, and the deposit will be forfeited. 2.5. Payment made by credit card will incur a processing fee. 3. Rescheduling 3.1. Customers may request to reschedule an event or delivery date by providing at least 14 days' notice. 3.2. Rescheduling requests made within 14 days of the event or delivery date will incur a rescheduling fee of 10% of the total quoted price. 3.3. Rescheduling is subject to availability, and the Company does not guarantee that the new requested date will be available with selected florals and may require a floral re-design. 4. Cancellation 4.1. Customers may cancel their booking or order by providing written notice to the Company. 4.2. Cancellation fees are as follows: More than 21 days before the event or delivery date: 20% of the total quoted price (deposit). Between 14 and 21 days before the event or delivery date: 50% of the total quoted price. Less than 7 days before the event or delivery date: 100% of the total quoted price. 4.3. In the event of a cancellation by the Company due to unforeseen circumstances, the Customer will be entitled to a full refund of all payments made. 5. Creative Oversight and Product Quality 5.1. The Company maintains creative oversight of all floral arrangements and designs. Final design decisions rest with the Company to ensure quality and aesthetic standards. 5.2. The Company strives to provide high-quality products. Due to the nature of our business and the fact that some of our flowers are grown outdoors, we cannot guarantee specific flowers, colours, or exact shades. 5.3. Any bespoke/special ordered sundries must be paid in full on quote approval/ signoff. A delay in payment may result in delayed delivery or the non-delivery of such bespoke items. 5.4. The Customer acknowledges that variations in colour, size, and shape are natural and that substitutions of equal or greater value may be made in the event of supply issues. 5.5. In the event of any dissatisfaction, the Customer must notify the Company within 24 hours of the event or delivery. The Company will make reasonable efforts to rectify any issues but does not guarantee specific outcomes. 5.6. All props and vessels are provided on a HIRE ONLY basis unless specified and remain the property of Flowers Vasette. 6. Event-Specific Terms 6.1. The Customer is responsible for providing accurate event details and ensuring that all necessary permits and permissions are obtained. 6.2. Any changes to the event details must be communicated in writing and may incur additional charges. 7. Liability 7.1. The Company is not liable for any indirect, special, or consequential damages arising out of or in connection with the event or sale of products/services. 7.2. The Company's total liability shall not exceed the total amount paid by the Customer. 8. Force Majeure 8.1. The Company shall not be liable for any failure to perform its obligations where such failure is due to circumstances beyond its reasonable control, including but not limited to acts of God, war, strikes, or supply chain disruptions. 9. Governing Law 9.1. These Terms shall be governed by and construed in accordance with the laws of the State of Victoria, Australia. 9.2. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia. 10. Contact Information 10.1.
